How Mothers' Rights Can Be Protected
Child Custody—As a mother, you have a legal right to seek child custody of your
child in the case of a divorce or the end of a relationship with the child's
father. You may be fighting for the right to have your child live with
you, the right to make important decisions for the child's life, or
both rights. These are referred to as physical custody and legal custody,
Visitation—You also have a right as a mother to seek visitation with your child
in the case that you and the child's father part ways. When you have
visitation set up, the child lives with the other parent but you have
given the right to spend time with your son or daughter on a regular schedule.
If the father of your child is not respecting the visitation schedule,
action can be taken to correct this problem.
Right to Be Included in Adoption Decisions—As your child's birth mother, you generally have the right to
decide whether or not your child can be put up for adoption. There are,
however, certain scenarios in which a birth mother's parental rights
might be terminated by the court, such as if the mother abandoned her
child or was shown as being unfit to care for the child.
