Emergency Child Custody in Torrance

Urgent Court Action for Child Safety & Removal Risks

An emergency custody request can seek temporary orders when a child faces an urgent danger or the risk of being removed from California. Patricia Barberis, A Law Corporation represents Torrance parents in these matters and the longer-term custody proceedings that may follow.

We focus exclusively on family law matters involving divorce, child custody, and support, and we have served the South Bay since 1977. Our custody representation includes parental alienation, denied visitation, and the urgent safety concerns addressed below, including abuse or neglect, domestic violence, substance abuse, mental illness, child endangerment, parental kidnapping, and poor living conditions.

When California Courts May Grant Emergency Custody

California Family Code section 3064 limits when a court can grant or modify custody without the usual notice and hearing process. The requesting parent generally must show immediate harm to the child or an immediate risk that the child will be removed from California.

The required danger may involve abuse, neglect, unsafe living conditions, domestic violence, substance abuse, child endangerment, or serious mental-health-related safety concerns. A credible risk of parental kidnapping or removal from the state can also support an emergency custody request.

Issues that may support emergency consideration include:

  • Recent abuse, neglect, or exposure to domestic violence
  • Living conditions that create an immediate safety concern
  • Substance use that places the child in immediate danger
  • Serious mental health circumstances connected to a current safety risk
  • Threats or actions indicating that a parent may take the child out of California

An emergency request isn’t designed to resolve routine parenting-time disagreements. Missed exchanges, communication disputes, or dissatisfaction with an existing schedule may require court attention, but they don’t necessarily meet the threshold for emergency relief. The court will consider the facts connecting the other parent’s conduct to a present danger or removal risk.

Forms & Notice for an Ex Parte Custody Request

California Rules of Court Rule 5.151 governs emergency applications for matters that can’t wait for the regular hearing calendar. An ex parte custody order provides temporary relief on an accelerated basis, often before the court has held a full hearing with both parents.

The application must identify the specific orders requested and present facts supporting the claimed emergency. A parent may seek immediate temporary orders through an emergency or ex parte Request for Order (FL-300).

An emergency child custody application may require:

  • Form FL-300: The completed Request for Order identifying the relief the parent wants the court to grant.
  • Existing orders: Current custody orders, if any, for an application made under California Family Code section 3064.
  • Form FL-105: A completed UCCJEA Declaration unless one is already on file. UCCJEA refers to the Uniform Child Custody Jurisdiction and Enforcement Act, which addresses jurisdiction over interstate custody matters.
  • Form FL-305: The form used to request temporary emergency orders concerning child custody and visitation.

California Rules of Court Rule 5.165 generally requires notice to the other parent or that parent’s attorney by 10:00 a.m. on the court day before the court considers the matter. The notice provides information about the requested orders and proceeding.

A judicial officer may waive notice for good cause, including when notice would frustrate the purpose of the requested order or cause immediate and irreparable harm to the applicant or affected children. A parent seeking a waiver must provide facts showing why notice shouldn’t be required.

Emergency Custody Proceedings in Torrance

Most Torrance custody cases are heard in the Los Angeles County Superior Court, with court appearances at the Torrance Courthouse. The courthouse provides Family Court Services for custody and visitation mediation, an Office of the Family Law Facilitator, and a Child Custody Evaluations office.

Court procedures, submission requirements, and hearing availability can affect how an application proceeds. We help parents define the requested relief, identify facts relevant to the urgent danger or removal risk, and prepare the required custody materials for court consideration.

Temporary Relief & Continuing Custody Issues

An emergency order is temporary. If the court grants immediate relief, it may set a later noticed hearing to consider continuing custody and visitation issues after the other parent has an opportunity to respond. The ultimate custody determination may involve a broader record than the initial emergency application.

We address both stages, accounting for the immediate safety concern while considering existing orders, parenting arrangements, and the custody issues likely to remain after temporary relief expires or is reconsidered.

Experience with Children’s Interests in Court

Colleen Barberis previously worked at the County Counsel Children’s Dependency Court. She later became certified as minor’s counsel, an attorney appointed by the court to represent a child’s interests, and has served as court-appointed minor’s counsel in custody and divorce disputes.

That experience informs our approach to allegations involving safety, family dynamics, and a child’s welfare. We present the requested relief and supporting facts clearly without assuming that the court will grant an emergency order or reach a particular custody outcome.

  • “Colleen was by my side”
Divorce can be very difficult, expensive and stressful. You need someone to talk to that could lead you in the right direction when you’re ready. Colleen was the right person to do that. She and Pat Barberis are the team that made me feel protected when I was the most vulnerable early in the divorce process. They were patient with me and Colleen was by my side in court when I really needed in person representation before the court.

  • “I would strongly recommend Pat”

Pat helped me with my divorce, which was a difficult time for me. She was fantastic, helping me through the whole process. She worked very hard to ensure it was as positive an outcome for me as possible.

When I turned to her for some legal advice just recently, several years after my divorce, I was able to set up a consultation with her that same day. She worked through the situation with me, understanding it and providing me with options that could be pursued, and giving me very solid advice. I would never hesitate to engage her again if the need arose. I would strongly recommend Pat for any family law needs you might have.

  • “Thank you so much”
Pat did a phenomenal job throughout my high conflict divorce. She will communicate all your options to you, she will advocate for you and fight for you, and she is so knowledgeable--her amount of expertise will put your mind at ease. She would be so prompt with all communications that if I ever had a question she would even respond to me after hours or on the weekends if needed (which I was super impressed with and it was much appreciated). Her team (which includes Colleen Barberis) and all of the office staff were incredible throughout the divorce and I will be forever grateful to them for getting me to the finish line with this divorce. I walked away with an incredible settlement and had a great outcome because of all their hard work. Thank you so much Pat, Colleen, and office staff!!
