Protecting Grandparent Rights

The law recognizes the special relationship grandparents have with their grandchildren and the importance of maintaining family ties. When a grandparent's relationship with their grandchildren is threatened, they have legal options.

The following are some examples of situations in which a grandparent may seek to enforce their rights:

  • A grandparent is not allowed to see their grandchildren
  • A grandparent is only allowed to see their grandchildren under supervised visitation
  • A grandparent is not allowed to talk to their grandchildren on the phone
  • A grandparent is not allowed to send gifts to their grandchildren
  • A grandparent is not allowed to attend their grandchildren's school functions
  • A grandparent's calls are monitored
  • A grandparent is not allowed to attend their grandchild's sporting events

Our firm is experienced in handling these and other situations. We know how the law works, and we are familiar with the judges and court personnel in the South Bay area.

We will help you understand your rights and figure out the best way to enforce them.

Seeking Visitation Rights

California law recognizes the importance of grandparents maintaining a relationship with their grandchildren. When a parent's behavior prevents a grandparent from having a meaningful relationship with their grandchild, the grandparent may seek court-ordered visitation.

  1. The petitioning grandparent has a relationship with the grandchild
  2. The grandchild's parents are dead or the grandchild's parents are divorced or separated
  3. The grandchild's parents have abandoned the child
  4. The child's parents have neglected or abused the child
  5. The child's parents are imprisoned

If the petitioning grandparent is asking for visitation because they have been denied access to their grandchild, they may request supervised or unsupervised visitation. If they are petitioning because the grandchild's safety is at risk, they may request supervised visitation only. Our experienced attorney can review your situation and help you determine the best course of action.

Enforcing Visitation Rights

When a parent is not allowing a grandparent to see their grandchild, the grandparent may seek enforcement of their visitation rights. Under California family code section 10/768, a grandparent may petition the court for enforcement of visitation rights if:

  1. The grandchild's parents have failed or refused to allow the grandparent visitation with the grandchild
  2. The grandchild's parents have failed or refused to send the grandchild to visit the grandparent at a time agreed upon by the parents

A grandparent may seek enforcement of visitation rights without first filing a petition for visitation rights. Our attorney can review your situation and determine the best course of action. We can help you seek enforcement of visitation rights of your grandchild.
