How Is Parental Alienation Handled by the Court?
Although a psychiatrist coined the phrase Parental Alienation Syndrome (PAS) to define this serious problem, it is often treated as an invalid diagnosis in the psychological community. In recent years, however, courts have become quicker to recognize and acknowledge parental alienation, which occurs when one parent attempts to degrade the other parent in front of the child. Many courts now use the term "parental alienating behavior" in place of Parental Alienation Syndrome.
There are generally three levels of parental alienation:
Mild
Moderate
Severe
The court encourages mild and moderate cases to be treated with therapy and increased time with the alienated parent. In more severe cases, therapy is not enough and the court may remove the child from the house of the alienating parent. Unfortunately, this custody revision can be slow-going and the problem continues growing worse overtime. Encouraging the court to act quickly requires aggressive legal advocacy.
