What Is a Prenuptial Agreement Under California Law?
A prenuptial agreement, also called a premarital agreement under California law, is a written contract signed by both parties before marriage. It establishes each party’s financial rights and obligations in the event of divorce, separation, or death. Without one, California’s community property rules govern the marriage by default: assets and debts acquired during the marriage are generally split equally between spouses, regardless of who earned or accumulated them.
A prenuptial agreement lets couples opt out of that default. Under California Family Code Sections 1600 through 1617, parties can designate specific property as separate rather than community, specify terms for spousal support, and allocate responsibility for debts. The agreement doesn’t replace your estate plan, but it works alongside it to direct assets according to your intentions.
Who Should Consider a Prenuptial Agreement?
A prenuptial agreement provides the clearest value when one or both parties have existing financial interests that deserve protection. Each scenario below represents a common reason Torrance couples come to us before the wedding.
Second marriages and blended families: If either party has children from a prior relationship, a prenup can designate specific assets for those heirs and help reduce unintended community property claims.
Business ownership: A prenuptial agreement can address whether a spouse acquires a community property interest in the business and establish in advance how the business would be valued in a divorce.
Significant premarital debts: When one or both parties carry substantial debt before the marriage, a prenup can ring-fence those liabilities so they don’t become shared obligations.
Inheritance protection: An inheritance is generally treated as separate property in California, but once commingled with marital assets, it can become subject to community property claims. A prenup can guard against that outcome.
Existing assets or investments: Parties entering marriage with real estate, investment accounts, or other holdings benefit from specifying in advance how those assets are characterized and divided.
What a Prenuptial Agreement Can Address
A well-drafted prenuptial agreement covers more than what happens at divorce. These are the core areas we work through with clients on premarital agreements:
Property and Asset Division: The agreement can address real estate, investments, business interests, and personal property acquired before and during marriage.
Spousal Support: The agreement may specify payment amounts and duration, or waive support entirely, subject to California’s enforceability requirements.
Debts and Liabilities: Existing debts can be allocated between the parties, and the agreement can establish rules for debts incurred during the marriage.
Estate Planning Designations: Specific assets can be designated for named beneficiaries, helping direct property to intended heirs regardless of what community property law would otherwise require.
Financial Responsibilities During Marriage: The agreement can define each spouse’s obligations for joint accounts, savings, and ongoing expenses.
California’s Requirements for a Valid Prenuptial Agreement
California imposes specific procedural requirements on prenuptial agreements, and failing to meet them can render an agreement unenforceable. Understanding these rules is part of why starting the process early matters.
Independent Representation & Financial Disclosure
Each party must be represented by their own independent attorney or must expressly waive that right in a separate writing. Both parties are required to make a complete and accurate disclosure of their assets, income, and debts before signing. An agreement reached without full financial disclosure may be unenforceable in court. The agreement must also be signed voluntarily. Under California Family Code Section 1615, a court can refuse to enforce a prenup if a party demonstrates duress, fraud, or undue influence.
The Seven-Day Waiting Period
California Family Code Section 1615 also requires a minimum of seven consecutive calendar days between the date the final version of the prenuptial agreement is presented to a party and the date it is signed. This rule can’t be waived. A prenup signed fewer than seven days before the wedding, or handed to a party at the rehearsal dinner, risks being invalidated by a court.
What a Prenuptial Agreement Can’t Control
There are limits on what a prenuptial agreement can address. Child custody and child support can’t be decided in advance; courts apply the best-interest-of-the-child standard at the time any dispute arises, regardless of what the parties agreed to before marriage. Terms a court finds unconscionable may be voided even if the rest of the agreement stands. Under California Family Code Section 1612, a spousal support waiver is only enforceable if the party giving up support was represented by independent counsel at the time of signing.
Why Starting Early Matters
Beginning the prenuptial agreement process several months before the wedding allows adequate time for financial disclosure, negotiation, independent review by each party’s attorney, and full compliance with the seven-day rule. Waiting until the month before the wedding can create unnecessary risk.
